Acceptable Use Policy
Version 2026-10-24 — Last updated: October 24, 2026
Anti-spam & code of conduct — English translation of the French Politique d’usage acceptable, which prevails in case of discrepancy.
Preamble
jenvoie.fr is an email marketing platform for responsible businesses that want to communicate with their prospects and customers respectfully and in compliance with the regulations.
The deliverability of all our users depends on everyone’s rigour. A single spammer can damage the reputation of the sending servers for hundreds of legitimate senders. That is why we apply a strict but fair policy, which protects your business as much as the quality of the Service.
This Acceptable Use Policy (the “Policy”) forms an integral part of the Terms. Any breach may lead to the immediate suspension or termination of the account, without notice and without refund.
1. The fundamental principle: consent
You may only use jenvoie.fr to send emails to recipients who:
- Have given you their freely given, specific, informed and unambiguous consent (B2C, in accordance with the GDPR and the ePrivacy Directive);
- Are business contacts you approach about a subject related to their role, on the basis of legitimate interest (B2B), with clear information and the ability to object (Article 21 GDPR).
Consent must have been collected explicitly (an unticked checkbox, double opt-in recommended, a clear sign-up form). Proof of consent (date, source, IP address, mechanism) must be available at all times.
2. Strictly prohibited practices
2.1 Contact lists
- Importing or using lists that were bought, rented, exchanged or obtained from third parties;
- Importing lists scraped from websites, online directories, social networks or public databases (Yellow Pages, LinkedIn, Google Maps, etc.);
- Importing contacts collected through contests or games without clear information about marketing use;
- Importing contacts whose consent you cannot demonstrate (date, source, mechanism);
- Reusing contacts for a purpose other than the one they consented to;
- Keeping in your lists people who have unsubscribed, marked your emails as spam, or explicitly asked not to be contacted again.
2.2 Email content
- Using misleading or sensationalist subject lines, or subject lines that do not reflect the content (“RE:”, “Confidential”, false promises);
- Hiding the sender’s identity or using a spoofed sender address;
- Omitting the unsubscribe link or making it hard to use;
- Omitting mandatory legal information (sender identity, postal address, purpose);
- Distributing unlawful, defamatory, hateful, discriminatory or pornographic content, or content that infringes the rights of third parties;
- Distributing disinformation, fake news or conspiracy theories;
- Including links to phishing sites, malicious downloads or illegal content.
2.3 Sectors and activities
The following are strictly prohibited, unless Gravity5 has given its express prior written consent:
- Pornography and adult content;
- Promoting weapons, explosives or illegal substances;
- Selling medicines without prescription, food supplements with unproven therapeutic claims, or unauthorised health products;
- Unregulated high-risk trading, binary options, pyramid schemes (aggressive MLM), payday loans, leveraged cryptocurrency trading promoted to non-professionals;
- Online betting, casinos and gambling from operators not licensed by the French gambling authority (ANJ);
- Scams, financial fraud, “get rich quick” offers, chain-letter schemes;
- Hacking, selling accounts or counterfeit licences;
- Tax evasion, money laundering, setting up shell companies;
- Any activity that is illegal in the sender’s or the recipient’s country.
2.4 Sending techniques
- Attempting to circumvent the anti-spam mechanisms of Gravity5 or third parties;
- Using several accounts to split sends in order to hide the real volume;
- Attempting to send emails without first verifying the sending domain (SPF, DKIM, DMARC);
- Using the Service for unsolicited bulk sends (spam, scams, phishing);
- Carrying out denial-of-service attacks, abusive automation of the API, or any use beyond normal usage limits.
3. Sending quality thresholds
To preserve collective deliverability, Gravity5 monitors the quality of sends and reserves the right to suspend accounts that persistently exceed the following thresholds (indicative, assessed over a rolling 30 days):
- Complaint rate (spam reports / FBL)
- Target < 0.1%. Above 0.3%, suspension possible.
- Hard bounce rate
- Target < 2%. Above 5%, suspension possible.
- Permanent SMTP error rate
- Target < 5%. A sign of outdated or non-opt-in lists.
- Open rate
- > 5% (indicative). A structurally very low rate may indicate a poor-quality list.
- Spam traps detected
- 0. Any detection may lead to immediate suspension.
These thresholds are indicative and may be adjusted depending on the context. Our goal is not to punish but to protect deliverability collectively.
4. Monitoring and reports
To enforce this Policy, Gravity5 may take the following measures:
- Quality checks on imported lists and on the deliverability of sends;
- Recommending and checking sending domain authentication (SPF, DKIM, DMARC); sends from a non-compliant domain may be refused;
- Monitoring deliverability indicators;
- Manual sampling of campaigns, with due regard for confidentiality;
- Prompt handling of reports sent to abuse@jenvoie.fr.
If you receive an email sent through jenvoie.fr that you consider abusive, you can report it to abuse@jenvoie.fr. We will handle your report seriously and confidentially.
5. Sanctions for breaches
In the event of a breach of this Policy, Gravity5 reserves the right to take the following measures, depending on the seriousness of the breach:
- A warning and a request to comply within a given period;
- Limiting the sending volume;
- Temporary suspension of the account;
- Immediate suspension without notice in the event of a serious breach (obvious spam, unlawful content, spam traps, mass complaints);
- Permanent termination of the account, without refund of the sums paid;
- Keeping account information to prevent any fraudulent re-registration;
- Reporting to the competent authorities (CNIL, police, anti-spam operators) in the event of a serious offence.
If a third party makes a claim or proceedings are brought against Gravity5 because of your use of the Service, you undertake to indemnify Gravity5 against all financial consequences, including reasonable defence costs.
6. Reinstatement procedure
If your account is suspended and you believe the suspension is unjustified, or if you have identified and fixed the cause of the breach, you can write to compliance@jenvoie.fr explaining:
- The identified cause of the problem;
- The corrective measures put in place (list cleaning, process changes, etc.);
- Your commitments for the future.
We review each request individually and reply within a reasonable time. The decision to reinstate an account is at Gravity5’s discretion.
7. Recommended good practices
Beyond the strict rules, we encourage you to adopt the following good practices:
- Use double opt-in on your sign-up forms;
- Send a welcome email right after sign-up;
- Segment your lists according to engagement and expressed interest;
- Regularly remove inactive contacts from your lists (for example after 12 months without interaction);
- Adapt the sending frequency to each segment’s engagement;
- Personalise content according to stated preferences;
- Test your emails on different clients and devices before sending;
- Configure SPF, DKIM and DMARC correctly, and a BIMI record where possible;
- Use a recognisable sender address and a domain you control (no @gmail.com address for your business campaigns).
8. Changes to this Policy
Gravity5 may amend this Policy to reflect changes in anti-spam good practices, regulations or deliverability standards. Any substantial change is notified by email with fifteen (15) days’ notice.
